The following terms and expressions in these Terms and Conditions have specific meanings unless the context requires otherwise:

1.      "You", "Yours", "Yourself", and "User" - This refers to any potential user or registered user of DBOI, including but not limited to customers and Commercial Partners.

2.      "Platform" - This refers to DBOI's website (https://diamondbazaarofindia.com/), its subdomains, and all other internet domains, the DBOI App, and other mobile applications, widgets, and downloadable applications developed, owned, and controlled by DBOI. The Platform provides the Services and is branded or licensed exclusively under the DBOI Copyright & Trademarks.

3.     "Content" - This refers to any information, data, text, files, logos, links, images, software, scripts, graphics, written posts and comments, algorithms, source code, machine code, interfaces, graphics, illustrations, animations, and interactive features generated or provided on the Platform or through the Services.

4.     "Orders" - This refers to an order made by a user on the Platform for the purchase of Products and/or services.

5.     "Products" - This refers to the goods and services provided by Third-Party Providers to Users through the Platform.

6.     "Services" - This refers to the services, content, features, applications, tools, data, documents, and information provided by DBOI through the Platform from time to time. It does not include any services provided by Third-Party Providers.

7.     "Third Party Provider(s)" - This refers to third-party merchants, vendors, or service providers who are registered with DBOI for providing the Products.

8.     "Loose Diamonds" - This refers to individual diamonds that can be bought by users, with or without being set on Mounts.

9.     "Mounts" - This refers to designs that hold a diamond or gemstone in place. which may or may not have diamonds/gemstones. Members can select Mounts and diamonds separately to create customized jewelry under the "Design Your Own" section.

 Sale Of Goods

All transactions made through this Website will be considered to have taken place at the corporate office of the company located at T-305, ABC Market, Mota Varachha, Surat – 394101, Gujarat, INDIA.

These transactions will be governed by the Sale of Goods Act, of 1930 and its subsequent amendments. The transaction is considered complete when a "Tax Invoice" is issued for the ordered goods, and the company will deliver the goods through a third-party courier or its delivery personnel.

 Taxes will be applied to all sales/supplies according to the Central Goods and Service Tax Act, 2017, the Gujarat Goods and Service Tax Act, 2017, and the Integrated Goods and Service Tax Act, 2017.

 The offer for sale is limited to the items displayed on the Website, and the company reserves the right to make changes to the brochure without notice. An order is only considered accepted when full payment is received and credited to the company's bank account.

 All diamonds sold by the company come with either a GIA, IGI, SGL, or HRD certificate that certifies their color, quality, and weight. All 22, 18, and 14 CARAT gold items sold by the company have a BIS Hallmark indicating their purity. The BIS hallmark is an inscription on the product, not a separate certificate.

 The jewelry products offered are handcrafted and made to order, and the company does not keep a ready stock of jewelry. Due to the handcrafted nature of the products, minor variations in weight and form of up to 10% may occur in comparison to the displayed product.

 Cookies

Product Description

We have made every effort to display as accurately as possible the colors and images of our products that appear on the website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. We do not warrant that product descriptions or other content of the website are accurate, complete, reliable, current, or error-free. We do not take responsibility for the diamond details which are directly coming from the suppliers.

Pricing

All prices are in Rupees however Users have an option to select currency as per their preference which includes all applicable taxes and shipping fees on the Final payment page. The total amount for any goods ordered must be made as a single payment. Prices are subject to change without notice. We cannot guarantee the availability of any product.

Payment

When you place an order with DBOI, you are required to make payment for all goods ordered when you are notified that your order has been accepted. Payment can only be made through debit card, credit card, or UPI, RTGS/NEFT. DBOI will only initiate the transaction once you have been notified of your accepted order. Additionally, you cannot make any set-off claims against DBOI's payment unless the amount is not disputed or has been the subject of a final and binding judgment. An invoice for the purchase will be sent to your registered email and with your package. The payment processing services for goods and/or services purchased on DBOIs website are provided by HDFC, located at The Capital, VCH 394101 Surat India, on behalf of DBOI Private Limited or another payment processing service, depending on the type of payment method used.

We accept a variety of payment methods, including credit cards, debit cards, Bank wire, UPI, and PayPal. For transactions up to INR 5,00,000, credit card and debit card payments are accepted. For transactions above INR 5,00,000, only bank wire transfers, NEFT, and RTGS are accepted.

 Please note that any additional fees or charges associated with the payment method are the responsibility of the customer. All payments are processed through a secure payment gateway to ensure the safety and security of our customers ' personal information. We reserve the right to refuse any order or cancel any transaction at any time for any reason.

Tax Liability

Every invoice generated will have CGST, SGST, and IGST taxes applied as per the government's rules and regulations.

 Shipping Policy

diamondbazaarofindia.com is aware of how critical it is for you to receive your diamond order promptly and safely. For this reason, we provide insured shipping on all of our orders to 9 different nations. Shipping costs may vary depending on location. And will be included when you checkout. All orders will be delivered via a trustworthy carrier and will need to be signed for as proof of identification.

 Please note that we only ship to physical addresses, not P.O. boxes. Once your order is shipped, you will receive a tracking number via email. You can use this number to track the progress of your shipment. Please allow 1-3 business days for your order to be processed and shipped. We take great care in packaging your diamond purchase to ensure it arrives to you safely. However, Minor damages or deformations or deteriorations in the course of the delivery are not covered by the transit insurance.

 Therefore, we at DBOI insist on making a video of the delivery products along with the third-party delivery person at the time of opening the package. The customer shall provide all information and documents, as required, to assist the company in lodging and substantiating claims against the insurer in the event of a loss (without providing such supporting information and documents over email the company has no liability to pursue it).

Pricing, Coupon Code, Discounts And Referral Program

At DBOI, we strive to provide you with the most competitive prices and best deals for the Products available on our platform. All prices displayed on our platform are obtained from Third-Party Providers who have offered to fulfill the Products.

We make an effort to keep the pricing of the Products up-to-date on our platform, but there may be instances where the suggested plans or prices may not be the latest. While we aim to provide accurate pricing information, errors may occur, and if a Product is listed with incorrect pricing or service information, we reserve the right to modify the price of the Product and notify the Customer for further instructions, or cancel the Product and inform the Customer of such cancellation. In such circumstances, the Customer will be required to make the additional payment for the Products to DBOI. We do not take responsibility for the diamond details which are directly coming from the suppliers

We offer Coupons as Discounts that can be redeemed for a financial discount when purchasing a Product. These Coupons are issued on behalf of DBOI and are subject to the standard terms and conditions mentioned by DBOI. Any damages or liabilities incurred by you while using the Coupon are not the responsibility of DBOI. Coupon codes can only be used on specific Orders, as deemed fit by DBOI, and may be refused at any time by DBOI. Expired coupon codes cannot be used on our platform.

Discounts offered by DBOI will be deducted during the payment process, and no claims for discounts will be entertained after the Order is confirmed. Discounts are subject to DBOI's discretion and can be altered or withdrawn without prior notice. DBOI is not responsible for any losses arising from the usage or non-usage of these discounts.

DBOI may also offer a referral program that allows you to refer friends to our platform and get rewarded. This program is subject to specific terms and conditions, and you can share your unique referral code with new users to register on DBOI.

During payment processing, you must use a debit or credit card, bank account, or internet wallet that you legally own or have authorization to use. You must provide correct and accurate details during the transaction process, and it is your responsibility to ensure that sufficient balance, limit, or payment capacity is present in the card bank account or Internet wallet.

Agreement to Use the Platform:

Prohibited Actions:

• You are not allowed to use the Platform in any way that breaches laws, infringes on third-party rights, or goes against these General Terms and Conditions.

• The Platform may contain links to other websites not under DBOI's control.
• DBOI is not responsible for the contents of these websites and accessing them is at your own risk.

Transaction between Users and Third-Party Providers:

• DBOI is not involved in any transaction between Users and Third-Party Providers.
• The purchase of Products with the help of Services is a private contract between the Users and Third-Party Providers.
• DBOI does not offer any commercial/contractual terms and all discounts and offers are made by the Third-Party Providers.
• You need to independently agree on the delivery, payment, insurance terms and conditions with the Third-Party Provider you transact with.
• The Third-Party Provider is responsible for fulfilling the Products ordered through the Platform.
• DBOI may cancel any Order if it is unable to fulfill it due to reasons beyond its control or attributable to the Third-Party Provider.

Assurances and Liabilities:

• DBOI does not make any assurances, representations, or warranties regarding the specifics of the Products sold/purchased on the Platform.
• DBOI does not endorse the sale/purchase of any Products on the Platform.
• DBOI accepts no liability for any errors or omissions made by itself or Third-Parties.

Monitoring and Disclosure of Information:

• DBOI may monitor, review, retain, and/or disclose any information on the Platform to comply with laws, regulations, legal processes, or governmental requests.

 Communications

If you, the user, do not instruct DBOI otherwise, registering your contact information implies that you give your consent to being contacted directly by us via phone, email, or other electronic messaging means, as outlined in our Privacy Policy.

 Your information, including your contact details, is necessary to complete any purchases of DBOI products and/or services. By registering with DBOI or making an order through this platform, you are granting permission for us to use your data. Without this consent, registration and ordering cannot be completed. Registration & Accounts

Users may become Members by registering on the Platform before conducting any transactions.

To register, users must provide personal information, including but not limited to name, address, company details, email, and phone number, along with a verification code. This process is only required once and Members who have already registered can simply log in to their account.

You are not allowed to share your username or password with anyone else. It is important to keep your login information confidential to prevent unauthorized access. You are solely responsible for any activities performed using your account, and the company will not be held liable for any misuse that results from you sharing your information with a third party.

Each user is allowed to have only one account and creating multiple accounts is prohibited. You cannot transfer or delegate your account rights or responsibilities without the company's prior written consent. KYC Documentation

DBOI reserves the right to request complete KYC documentation at any time before or after account activation. If the documentation is not provided within the specified time frame, DBOI reserves the right to temporarily halt the account's future transactions. It is mandatory to provide KYC documentation for any transaction on our platform.

1.  Introduction

2.   Registration

•  2.1 The DBOI platform is exclusively accessible to registered users who have been granted access permission through the internal assessment conducted by the Diamond Bazaar Of India team.
•  2.2 To register for the DBOI platform, users must provide their mobile number and email address. By doing so, users consent to receive communications from Diamond Bazaar Of India.
•  2.3 Users may be required to provide additional information and documentation to verify their identity and eligibility, which will be reviewed by the Diamond Bazaar Of India team.
•  2.4 Diamond Bazaar Of India reserves the right to deny access to any user at its sole discretion.
•  2.5 Once a user has been granted access, they can access the DBOI platform by logging in with their registered email and password.

3.  Use of DBOI Platform

• 3.1 DBOI members can access exclusive features and products, including natural diamond stones above 10 carats and natural fancy color stones above 2 carats.
• 3.2 Members may also purchase both natural fancy diamonds (DBOI) and lab-grown diamonds in a single order.
• 3.3 DBOI members may view and purchase products on the DBOI page, which can be accessed from the Buyer Home Page.
• 3.4 The DBOI platform is provided on an "as is" and "as available" basis, and DBOI makes no representations or warranties of any kind, express or implied, as to the operation or availability of the platform or the accuracy or completeness of any information provided.

4.  Communication and Privacy

• 4.1 By providing your mobile number and email address, you consent to receive communications from DBOI about your use of the platform.
• 4.2 DBOI respects your privacy and will handle your personal information in accordance with its Privacy Policy.

5.  Intellectual Property

• 5.1 The DBOI platform, including all content, trademarks, and logos, is owned by Diamond Bazaar Of India or its licensors and is protected by intellectual property laws.
• 5.2 Users may not reproduce, modify, distribute, display, or exploit any part of the platform without Diamond Bazaar Of India's prior written consent.

6.  Termination

• 6.1 Diamond Bazaar Of India may terminate a user's access to the DBOI platform at any time and for any reason, without notice.
• 6.2 Users have the option to discontinue their access to DBOI and cease using the platform by informing Diamond Bazaar Of India in written form.

7.   Disclaimer of Liability

• 7.1 To the fullest extent permitted by law, Diamond Bazaar Of India disclaims all liability for any loss, damage, or injury arising out of or in connection with the use of the DBOI platform, including but not limited to any direct, indirect, consequential, or incidental damages.
• 7.2 Diamond Bazaar Of India makes no representations or warranties regarding the quality, safety, or legality of any products offered on the platform.

8.  Governing Law and Dispute Resolution

• 8.1 These terms and conditions are governed by and construed in accordance with the laws of the State of Gujarat, without giving effect to any principles of conflicts of law.
• 8.2 Any dispute arising out of or in connection with these terms and conditions shall be resolved exclusively through binding arbitration in accordance with the Commercial Arbitration Rules of the Arbitration and Conciliation Act 1996.

9.  Changes to Terms and Conditions

• Diamond Bazaar Of India may modify these terms and conditions at any time and in its sole discretion

Copyright & Trademark

You are not allowed to copy, distribute, perform publicly, make available to the public, disassemble, separate, modify, sub-license, use commercially, sell, rent, lend, process, connect, reverse-engineer, combine with other programs, translate, change or create any derivative works of the intellectual property unless explicitly allowed under these Terms. This applies to both yourself and any third party acting on your behalf.

The "Diamond Bazaar Of India" name, the company name, commercial symbols, and other proprietary identifiers used by the company in connection with the Platform and/or Services, as well as the platform's domain name, are all trademarks and company trademarks, even if they are not registered. Any other trademarks, business names, identifying signs, and commercial symbols that may appear on the Website, Application, and/or Services, belong to their respective owners and are referred to as "Third Party Trademarks".

 These trademarks are used on the Platform for identification purposes only and belong to their owners. No rights, license, or ownership of the company's or third-party trademarks are granted through this; therefore, you must avoid using any of these trademarks unless explicitly allowed under the Terms.

The trademarks, names, logos, and service marks displayed on this platform are a combination of registered and unregistered trademarks of the platform owner. Nothing on this platform should be interpreted as granting any license or right to use any trademark without the prior written permission of the platform owner.

 Purchase Agreement

Orders placed through the platform create a binding agreement between you and Diamond Bazaar Of India to finalize the purchase. The agreement is only considered official once Diamond Bazaar Of India accepts your order by shipping the requested goods through a partner delivery service. You will receive notifications through email, SMS, and push notifications when the goods have been dispatched.

 The General Terms and Conditions are part of any purchase agreement made through the platform. The prices and fees displayed on the platform at the time of order submission will be charged to you. The final price cannot be confirmed until the order is submitted and approved by Diamond Bazaar Of India, and your payment will not be processed until then.

Order Information

ORDER PLACED

Definition: "Order Placed" refers to the action taken by the Buyer/Dealer to place an order on the platform.

The act of placing an order does not guarantee the availability of the diamond and/or the delivery of the stone. It serves as a confirmation of the Buyer’s/Dealer’s intention to purchase the stone.

DBOI may cancel placed orders under the following rare, but possible circumstances:

1.     In case of errors in the price or diamond information listed on the website.

2.     If the diamond turns out to be unavailable.

3.     If the diamond has already been sold.

4.     If payment has not been received to DBOI unless verified by the bank.

Both the Buyer and DBOI have the option to reconsider and/or cancel the placed order within 1 hour, subject to conditions.

If an order is canceled by DBOI, a communication regarding the cancellation will be shared with the Buyer/Dealer, typically within, or after 1 hour of the order being placed.

For orders placed outside working hours/working days or during National holidays, DBOI will finalize or cancel the order only after the availability of the stone is confirmed on the next working day.
